Pensions & RRSPs 연금과 은퇴적금

Most pension plans and RRSPs (excluding recent contributions in 12 months). 대부분 연금, 은퇴적금 (, 지난 12개월 이내에 불입한 RRSPs 제외).

 

 

1.    Food and fuel: no dollar limit.

2.    Clothing: no dollar limit.

3.    Household goods: up to $6,500, more in some cases.

4.    One motor vehicle: up to $3,000, or up to $6,500 if needed in occupation.

5.    Health aids: no dollar limit.

6.    Principal residence: none.

7.    Tools of any occupation: up to $1,000.

§  Farm equipment, fishing nets, tools and implements used in debtor's chief occupation, not exceeding $1,000.

8.    Seeds and livestock for domestic use: no dollar limit.

9.    RRSPs:

  • Effective July 7, 2008 exemptions are in effect for all registered retirement savings plans (RRSP's, RRIF's and DPSP's (Deferred Profit Sharing Plans).

  • Except, contributions made in the 12 months prior to the date of bankruptcy will be recovered (clawed back) for the benefit of the bankruptcy estate for RRSPs in provinces without RRSP exemption laws (BC, Alberta, Ontario, NB, and NS);

  • There will be no upper cap on the amount of RRSPs that can be protected;

  • There will be no need to set up the RRSPs in a locked in plan to make them eligible for exemption;

  • The court will have no jurisdiction to extend the one year claw back period in an appropriate case.
